Introduction
These terms and conditions govern the provision of a cybersecurity assessment service (“Service”) provided by Fusion5 (“Provider”) to the customer (“Customer”) under the promotional offer (“Offer”). By participating in the Offer, the Customer agrees to be bound by these terms and conditions.
Offer Details
- The Offer includes a 60% discount on the standard price of the Provider’s CSA, reducing the cost from $12,000 NZD to $5,000 NZD.
- The Offer is valid for purchases made before 30 May 2024.
- Services under the Offer are to be rendered by April/May 2024, contingent on the Customer’s sign-up date.
- The Customer is entitled to discounted prepaid remediation/advisory hours, to be consumed within 90 days of the assessment delivery.
Eligibility
- The Offer is available to businesses legally operating in New Zealand.
- The Customer agrees to the terms and conditions at the time of registering.
Payment
- Full payment of the discounted rate must be received prior to the commencement of services.
- The Offer is not valid in conjunction with any other promotions or discounts.
Scope of Service
- The Service will be delivered in accordance with the predefined scope outlined in the engagement process provided by the Provider.
- Any services requested by the Customer outside of this scope may incur additional charges.
Prepaid Remediation/Advisory Hours
- If discounted prepaid hours are purchased, they must be utilised within 90 days from the delivery of the assessment report.
- Unused hours after 90 days will expire and are non-refundable and non-transferable.
Cancellation and Refund
- Cancellations made within 7 days of signing will receive a full refund.
- Cancellations after this period may be subject to a cancellation fee as determined by the Provider.
Data Protection
The Provider will adhere to applicable data protection laws in handling any data obtained during the assessment.
Confidentiality
Both parties agree to maintain the confidentiality of information disclosed during the course of the assessment.
Liability
The Provider's liability in connection with the Service will be limited to the amount paid by the Customer under this Offer.
Intellectual Property
All intellectual property rights in any materials provided during the Service remain the property of the Provider.
Disputes
Any disputes arising in connection with these terms and conditions will be resolved through negotiation, or if necessary, under New Zealand law in the New Zealand courts.
Amendment
The Provider reserves the right to amend these terms and conditions without prior notice.
Governing Law
These terms and conditions are governed by the laws of New Zealand.
Acceptance
The Customer indicates acceptance of these terms and conditions by purchasing the Service under the Offer.
